EPA Could Release Both RFS, WOTUS Rules This Week

This is going to be a busy week for the regulatory gurus at the Environmental Protection Agency.

EPA told petroleum and ethanol groups in April that the agency intended to release by June 1 the 2014, 2015 and 2016 renewable volume levels with the rules being finalized by Nov. 30. Well, June 1 falls on Monday but we'll have to see if EPA goes ahead and releases the rule this week or waits until the last second on June 1 to issue the rule.

The corn market and soybean markets have lot riding on where EPA sets those levels over the two years.

Besides the RFS, though, EPA appears also determined to release the rule rewrite for the Clean Water Act this week with the U.S. Army Corps of Engineers. The "waters of the U.S." rule has been widely resisted by agriculture and businesses. EPA is moving ahead despite the House vote earlier in May to block EPA from implementing the rule. Similar bills have been introduced in the Senate.

Major newspapers have reported since late last week that EPA would release the new rule this week as well. I suspect it will draw some immediate responses.
